These Terms govern the use of our websites, website content, downloads, product information and other services provided directly by GSILVER Audio.

Paid products are sold through FastSpring, our Merchant of Record. The purchase transaction itself is subject to FastSpring's applicable Terms of Sale.

Software products may also be subject to separate End User License Agreements (EULAs).

Our websites provide information about GSILVER Audio and our products.

We make reasonable efforts to keep information accurate and up to date. However, product descriptions, specifications, compatibility information, screenshots, prices, availability and other content may be changed or updated where necessary.

Information provided on our websites does not constitute a guarantee of specific product characteristics unless expressly stated otherwise.

4. Copyright and Intellectual Property

Unless otherwise stated, all original content on our websites, including text, graphics, logos, product names, user interface designs, images, screenshots, audio material and other content, is owned by GSILVER Audio or used with permission.

Website content may be viewed and used for personal or informational purposes.

It may not be reproduced, modified, distributed, republished or commercially exploited without our prior permission, except where permitted by applicable law.

Third-party product names, trademarks and registered trademarks remain the property of their respective owners. References to third-party products or brands do not imply affiliation, sponsorship or endorsement unless expressly stated.

5. Software and Downloads

Software, installers, demo versions, documentation, themes, presets and other downloadable files made available through our websites may be subject to separate license terms or an End User License Agreement.

Downloading or accessing software or other digital content does not grant any rights beyond those expressly provided under the applicable license terms.

Technical requirements, supported operating systems and compatibility information are described on the relevant product page or in the applicable documentation.

Users are responsible for ensuring that their systems meet the stated requirements before installing or using a product.

6. Purchases through FastSpring

Paid products offered through our websites are sold and processed by FastSpring, our Merchant of Record.

The purchase contract for paid products is concluded between the customer and FastSpring. FastSpring handles the purchase transaction, including payment processing, invoicing, applicable taxes and other transaction-related matters.

The price and transaction details displayed in the FastSpring checkout at the time of purchase apply to the purchase.

GSILVER Audio remains the developer, provider and licensor of the software. The right to use GSILVER Audio software is governed by the applicable End User License Agreement.

7. Refunds and Statutory Withdrawal Rights

Because our software is delivered digitally and, where offered, a free demo allows customers to evaluate the product before purchase, purchases are generally final and non-refundable once the product has been delivered.

Refunds may nevertheless be granted where required by applicable law or in appropriate cases, including duplicate purchases, failed delivery or a material technical defect that cannot reasonably be resolved.

FastSpring may also issue refunds in accordance with its applicable policies, payment requirements and legal obligations.

Consumers may have statutory withdrawal rights under applicable law. Consumers in the European Economic Area may generally have a statutory withdrawal period of 14 days for distance contracts, subject to applicable statutory conditions and exceptions.

For digital content supplied immediately, a statutory right of withdrawal may expire before the end of the withdrawal period where all legal requirements for such expiry have been fulfilled. Depending on applicable law, this may include the consumer's express consent to immediate performance, acknowledgement that the right of withdrawal will thereby be lost, and any legally required confirmation.

Nothing in these Terms limits or excludes mandatory statutory consumer rights.

Customers may submit refund requests, withdrawal requests, payment enquiries and other purchase-related enquiries through FastSpring Consumer Support. FastSpring may refer product-specific or technical matters to GSILVER Audio where appropriate.

8. Warranty and Statutory Rights

GSILVER Audio does not provide any additional voluntary commercial guarantee or warranty unless expressly stated for a particular product.

This does not affect any mandatory statutory rights, including statutory rights relating to defective digital products or other consumer protection rights that cannot legally be excluded or limited.

Where FastSpring is the seller, rights and claims arising from the purchase contract are governed by applicable law and FastSpring's applicable Terms of Sale.

GSILVER Audio provides reasonable technical support for product-related issues in accordance with the support information provided on our websites.

9. Acceptable Use

Our websites may only be used for lawful purposes.

You must not:

• interfere with the operation, availability or security of our websites;
• attempt to gain unauthorized access to systems, accounts or non-public areas;
• distribute malicious software or harmful content through our websites;
• use automated systems in a way that places an unreasonable load on our websites;
• circumvent technical protection measures;
• use GSILVER Audio content in a misleading manner;
• falsely imply affiliation with, sponsorship by or endorsement by GSILVER Audio.

These websites and services are operated independently and are outside our control. A link does not imply endorsement of the third-party website, its operator, products or services.

Responsibility for third-party content and services remains with the respective provider.

11. Availability and Changes to Services

We aim to keep our websites and downloadable content available and functioning reliably.

However, uninterrupted or error-free availability cannot be guaranteed.

Our websites, downloads or individual functions may be changed, suspended or temporarily unavailable, for example due to maintenance, technical issues, security requirements or product updates.

Products and services may also be modified, replaced or discontinued where reasonably necessary, subject to any mandatory rights of existing customers.

Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited.

In particular, nothing in these Terms limits liability for intent or gross negligence, injury to life, body or health, liability under mandatory product liability law, or any other liability that cannot legally be excluded or restricted.

13. Governing Law

These Terms, insofar as they govern the legal relationship between users and GSILVER Audio, are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law does not deprive them of mandatory protections granted by the law of the country in which they have their habitual residence where such protections are applicable.

The purchase contract between a customer and FastSpring is governed separately by FastSpring's applicable Terms of Sale.

14. Severability

If any provision of these Terms is or becomes invalid or unenforceable, the validity of the remaining provisions will not be affected.

Where applicable, the relevant statutory provisions shall apply in place of any invalid or unenforceable provision.

15. Changes to These Terms

We may update these Terms where reasonably necessary, for example to reflect changes to our websites, products, services, technical processes or applicable legal requirements.

The current version will be published on our websites together with the date of the latest update.

Changes will apply prospectively and will not retroactively reduce mandatory rights relating to purchases already completed.
